Whistler Blackcomb's 'Wonderstruck Contest' Official Rules

ELIGIBILITY:  Whistler Blackcomb's "Wonderstruck Contest" (the "Contest") is open to residents of Canada, the United States of America and the United Kingdom who have reached the age of majority in the province or state in which they reside at the date of entry.  Employees, representatives and agents of Whistler Mountain Resort Limited Partnership and Blackcomb Skiing Enterprises Limited Partnership (collectively, "Whistler Blackcomb") and their respective affiliates, prize suppliers, advertising and promotion agencies and members of the immediate family (parent, child, sibling and spouses) of all such persons as well as those with whom they are domiciled are not eligible to enter.  Void where prohibited by law.

SPONSOR: The Sponsor of this Contest is Whistler Blackcomb, with an address at 4545 Blackcomb Way, Whistler BC V0N 1B4 Canada.

HOW TO ENTER:  No purchase necessary to enter or win. A purchase will not improve your chances of winning.  The Contest will begin at 12:00:01 a.m. (Pacific Time ("PT")) on September 10, 2012 and will end at 11:59:59 p.m. (PT) on January 31, 2013 (the "Contest Period").  To enter, go to the Official Entry section at http://www.whistlerblackcomb.com/contest during the Contest Period, complete all required information on the 'enter' page and click 'submit'.  You may also enter by properly completing an official paper ballot and placing the ballot in an official ballot box found at various locationsduring the Contest Period.  If you wish to know the exact availability of the ballot boxes, call 604 932 3141.

Participation is limited to one entry per email address and one entry per person.

All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the Rules (defined below) may be disqualified by Whistler Blackcomb.  Whistler Blackcomb takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical, production or other errors.  Notably, Whistler Blackcomb is not responsible for any errors or omissions in printing or advertising the Contest or in these Official Rules.

PRIVACY: By entering the Contest, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Contest and for the purposes of understanding the needs and preferences of individuals or to develop, enhance, market and/or provide products and services, as more particularly described in the Whistler Blackcomb privacy policy.

Whistler Blackcomb will collect, use and disclose  such personal information in accordance with the Whistler Blackcomb privacy policy, which can be found at http://www.whistlerblackcomb.com/privacy/index.htm and the Rules.

RULES:  The Contest will be run in accordance with these Official Rules (the "Rules").  Entrants must comply with the Rules, and will be deemed to have received and understood the Rules by participating in the Contest.  Whistler Blackcomb may, at their discretion, cancel, terminate, suspend and/or amend the Contest and the Rules, subject to the prior approval of the Régie des alcools, des courses et des jeux in Québec, where necessary.  The terms of the Contest, as set out in the Rules, are not subject to amendment or counter-offer, except as set out herein.  Whistler Blackcomb's decisions with respect to the Contest are final and binding.  If any provisions of the Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

GRAND PRIZE DRAW:  A random draw by a representative of Whistler Blackcomb will be held at 4545 Blackcomb Way, Whistler BC at 1 pm PT on February 4, 2013 from among all eligible entries received during the Contest Period in order to select one entrant for the Grand Prize.  Entrants do not have to be present at the draw in order to qualify to win.  The following Grand Prize is available to be won, subject to the conditions set out below:

Grand Prize:

The Grand Prize is comprised of the following:

• Seven (7) nights at the Fairmont Chateau Whistler for winner and one (1) guest;
• Round trip economy airfare for winner and his/her guest to Vancouver International Airport from any one Air Canada destination in North America, or the United Kingdom.  Airfare Courtesy of Air Canada, airfare taxes and fees courtesy of Whistler Blackcomb.
• Transfers from Vancouver International Airport to Fairmont Chateau Whistler for winner and his/her guest;
• Seven (7) day lift ticket package at Whistler for winner and his/her guest;
• Private behind the scenes ride along on a snow groomer for winner and his/her guest;
• One (1) Elite Package heli ski trip with Whistler Heli Skiing for winner and his/her guest;
• 'Fresh Tracks Mountain Top Breakfast presented by the Globe & Mail' with an Olympian for winner and his/her guest (set menu);
• Lunch for winner and his/her guest at Christine's Restaurant on Blackcomb Mountain, followed by dessert, tea and coffee (set menu) on a private PEAK 2 PEAK Gondola ride;
• Private table at the Garibaldi Lift Co. Bar & Grill (GLC) with VIP viewing for Fire & Ice Show (set menu);
• Three (3) days of private instruction/guides with Whistler Snow School for winner and his/her guest; and
• One ski or snowboard equipment package for winner and his/her guest from CAN-SKI or Showcase-details below.

Grand Prize Conditions:

• All elements of the Grand Prize must be redeemed by winner during one trip completed between March 1st, 2013 and April 21st, 2013, inclusively, subject to availability.  Dates are subject to change at discretion of Whistler Blackcomb.  Fresh Tracks Mountain Top Breakfast and the Fire & Ice Show end on April 6, 2013. If winner arrives after that date these elements of the prize will not be available.
• Air Canada: Flights are subject to availability at time of booking and travel blackout restrictions apply between March 28th and April 2nd 2013. Once ticket has been issued, origin and destination cannot be changed. Winner and his/her guest must travel on same travel itinerary.  All applicable fees, such as airport departure taxes, security charges, fuel surcharges and baggage fees are the sole responsibility of the bearer of the ticket, unless otherwise stated by Whistler Blackcomb. Ticket is non-transferable, non-refundable and not redeemable for cash. Frequent flyer mileage and stopovers are not permitted. Promotional pass recipients may be held liable to Air Canada for failure to adhere to the restrictions and conditions of travel applicable to their tickets or for the fraudulent use of those tickets. The winner will be provided with a promotion code to book their flights which is for one-time use only and for their personal use.  It may not be distributed or sold, or otherwise used for commercial or personal gain, other than for the purpose for which it is intended. Air Canada reserves the right to modify or cancel the promotion code at the discretion of Whistler Blackcomb. Any violation of these conditions may be subject to cancellation of the promotion code, of any booking made using the promotion code, and/or to any legal or other recourse available for the recovery of damages suffered or costs, expenses or loss incurred as a result of such prohibited use.
• Certain components of the Grand Prize may be subject to additional rules, restrictions or conditions (for example that the winner and his/her guest must possess a certain level of skiing or snowboarding ability to partake in certain activities).  Winner and his/her guest agree to such rules, restrictions and conditions and acknowledge that if any applicable conditions are not met, winner may not be eligible to redeem the relevant components of the Grand Prize.
• Fairmont Accommodation.  Based on availability.  Blackout dates applies on March 30th and other dates may apply.  Either the winner or his/her guest must be at least 19 years old and must have a valid credit card.  The winner will be responsible for all incremental charges, including parking, and any other charges incurred during their stay.  
• Accommodation and prize fulfilment arrangements must be co-ordinated with Whistler Blackcomb.
• Depending on the specific accommodation unit assigned to winner and his/her guest, the winner may be entitled to invite additional guests to share the unit with him/her, subject to the maximum occupancy of the unit. These additional guests will not receive any of the other prize components and will be solely responsible for all costs and expenses associated with travel, transportation, food, activities, and taxes.
• Winner is responsible for all meals, beverages, travel and ground transportation, taxes, gratuities, activities, insurance, required passports or other travel documents and any other costs and expenses which are not explicitly stated in the Rules as being included in the Grand Prize.
• Fresh Tracks Breakfast prizing must be redeemed during 2013 Fresh Tracks operating dates. The Olympian will be chosen by Whistler Blackcomb, at its discretion and subject to availability.
• Ski or snowboard equipment package includes either two (2) sets of hard goods (skis, boots, bindings or poles) from CAN-SKI, or two (2) sets of hard goods (board, boots or bindings) from Showcase, or one (1) set of hard goods from CAN-SKI and one (1) set of hard goods from Showcase.  Whistler Blackcomb will select the make and type of the hard goods, at their discretion.

Total approximate retail value of the Grand Prize is $14,898CDN/$14,898 US* plus applicable taxes.  Any difference between stated approximate retail value and actual prize value will not be awarded.  The above prize description constitutes the expected Grand Prize and all aspects thereof are subject to availability and subject to change. Certain components of the Grand Prize may not be available at time of prize fulfilment.  Winner will be provided with additional details at time of prize fulfilment.

ODDS:  The odds of winning the Grand Prize depend on the number of eligible entries received during the Contest Period. 

WINNING AND NOTIFICATION:  The entrant selected to win the Grand Prize will be notified by email and/or phone on or about February 4th, 2013.  Before being declared a winner of the Grand Prize, a selected entrant who is a resident of Canada must correctly answer unaided a time-limited mathematical skill-testing question.

Before being declared a winner of the Grand Prize, the selected entrant will be required to sign and return to Whistler Blackcomb within the period indicated thereon a declaration and release form, notably: confirming compliance with the Rules and acceptance of the Grand Prize as offered; acknowledging the non-responsibility of Whistler Blackcomb and their respective employees, directors, officers, representatives and agents with respect to liability, damage, injuries, accident, loss or misfortune relating to (i) participation in the Contest or any related activity, and (ii) acceptance, possession, use or misuse of the Grand Prize or any component thereof, to the extent permitted by law; and acknowledging the right of Whistler Blackcomb's and their respective employees, directors, officers, representatives and agents to collect and publish or broadcast the winner's likeness, name, address, voice and statements made in relation to the Contest in any publicity, promotion or advertisement carried out by Whistler Blackcomb or its authorized agents worldwide without further notice or compensation, other than the prize offered.  In the case of UK residents, this declaration and release must be signed upon the winner's arrival in Canada.

In the event that a selected entrant is not eligible to claim the Grand Prize or does not claim it within one (1) week of the draw, or is unwilling or unable to comply with the Rules, or any prize notification is returned as undeliverable, his/her entry will be disqualified and an additional entry will be drawn from among remaining eligible entries received during the Contest Period until such time that the Grand Prize has been successfully awarded.

Winner is solely responsible for the reporting and payment of any applicable taxes on or associated with the acceptance and use of the Grand Prize.  Winner may waive his/her right to receive the Grand Prize or any component thereof.  The Grand Prize and its components are non-transferable, non-exchangeable, and non-refundable, have no cash value and must be accepted by winner as awarded.  The Grand Prize will be forfeited if winner is not able to redeem it during the time period designated by Whistler Blackcomb.  Any guest accompanying winner will be required to sign and return a declaration and release form prior to taking part in the Grand Prize.  If winner's guest is a minor, he/she must be accompanied by his/her parent or legal guardian during his/her participation in the Grand Prize, at the parent or legal guardian's expense (unless the latter is, in fact, the winner), and the parent or legal guardian must sign and return all required documentation.  Whistler Blackcomb and the prize suppliers reserve the right to substitute the Grand prize or a component thereof with a prize of equal or greater value in the event that the Grand Prize or a component thereof is unavailable due to circumstances beyond their control.  The name of the winner will be posted at http://www.whistlerblackcomb.com/contest.

Entrants acknowledge that the Contest is sponsored by Whistler Blackcomb.  By entering the Contest, entrants acknowledge that they have read, understood and agreed to be bound by the Rules. 

RELEASE:  By entering the Contest, entrants acknowledge that they are releasing Whistler Blackcomb, their respective directors, officers, employees, representatives, agents, affiliates, prize suppliers, advertising and promotion agencies (collectively, the "Releasees") from any liability whatsoever for any claims, costs, injuries, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Contest or any related activity, or (ii) the acceptance, possession, use or misuse of the Grand Prize or any component thereof, (including, without limitation, those related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), to the extent permitted by law.  By entering the Contest, entrants also agree to fully indemnify the Releasees and hold each of them harmless from any and all claims, costs, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Contest or any related activity, or (ii) the acceptance, possession, use or misuse of the Grand Prize or any component thereof, by any third party.  For UK residents: Notwithstanding anything to the contrary in these Rules, where the entrant resides in the UK and accepts these Rules from the UK, the exemptions and limitations of liability set out in these Rules shall not operate to exclude or restrict any person's liability for death or personal injury resulting from such person's negligence, nor to exempt or restrict a person's liability for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.

Winner acknowledges that the Releasees are not responsible for: (a) any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail entry to be received by Whistler Blackcomb on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to an entrant's or any other person's computer, related to or resulting from playing or downloading materials in this promotion including the recording of game results; (b) any incomplete or inaccurate information, whether caused by the website users or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; or (c) the theft, destruction or unauthorized access to, or alteration of, entries or the contest website.  Whistler Blackcomb reserves the right, in their sole discretion, to cancel, modify or suspend the Contest should a virus or bug or other cause beyond the reasonable control of Whistler Blackcomb corrupt the security or proper administration of the Contest.  Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Whistler Blackcomb reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  Whistler Blackcomb reserves the right to forbid the framing of any of the contents of the contest website and, in their sole discretion, to disqualify any individual who tampers with the entry process.

All entries become the property of Whistler Blackcomb and will not be returned.  If the identity of an online entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant.  The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the entrant.  A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.  All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search.  The sole determinant of time for the purposes of receipt of a valid online entry in the Contest will be the server(s) of Whistler Blackcomb.

DISPUTES: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest, any prize awarded or any use of any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the province of British Columbia, Canada to the extent permitted by law.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Whistler Blackcomb in connection with the Contest, any prize awarded or any use of any prize awarded, shall be governed by, and construed in accordance with, the laws of the province of British Columbia, Canada, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the province of British Columbia, Canada.

FOR QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

*NOTE: All prizes are quoted in Canadian currency (CDN) and calculated into approximate USD currency (US) using an exchange rate of $1 US = $1 CDN.  Exchange rates are subject to change at any time.
